Welcome to Swiftaudit!

1. Your agreement with SpringSoft Medical Inc.

Your use of Swiftaudit is governed by this agreement (“Agreement”). "SpringSoft" means SpringSoft Medical Inc., mailing address of 900 S. Preston Rd #285, Prosper, Texas 75078, United States, and its licensors, subsidiaries or affiliates involved in providing Swiftaudit.com

2. Not Medical Advice; U.S. Use Only

Swiftaudit does not offer medical advice. All content accessed through Swiftaudit is for informational purposes only. This content should not be used during a medical emergency or for the diagnosis or treatment of any medical condition. A licensed physician or other qualified health care provider should be consulted for diagnosis and treatment of any and all medical conditions. Do not ignore or delay obtaining professional medical advice because of information accessed through Swiftaudit. Call 911 or your doctor for all medical emergencies.

Links to other sites are provided for information only -- they do not constitute endorsements of those other sites.

You may only use Swiftaudit.com if you reside in the United States.

3. License Grant, Proprietary Rights

SpringSoft and its licensors reserve all respective intellectual property rights in the services provided by Swiftaudit.com. SpringSoft and its licensors own all respective proprietary rights to Swiftaudit, its logos, trademarks, and derivative works. Trademarks and logos used in connection with Swiftaudit are the trademarks of their respective owners. SpringSoft gives you a personal, revocable, non-assignable, and non-exclusive license to use Swiftaudit.

4. Your Account and Use of Swiftaudit

You must provide accurate and complete registration information any time you register to use Swiftaudit. You are responsible for the security of your passwords and for any use of your account. You must immediately notify SpringSoft of any unauthorized use of your password or account. Your use of Swiftaudit and any content accessed through Swiftaudit must comply with all applicable laws, regulations and ordinances, including any laws regarding the export of data or software. You must be at least 18 years old to use Swiftaudit.

SpringSoft takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record confidentiality resulting from your sharing or losing your Swiftaudit account credentials.

You may not access Swiftaudit other than by the interfaces provided by SpringSoft nor interfere with nor disrupt the proper operation in any other way of Swiftaudit.

5. Member Account, Password, and Security

To use Swiftaudit.com you are required to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You are required to enter a secure password. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify SpringSoft immediately of any unauthorized use of your account or any other breach of your security. SpringSoft will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge, due to breach of your security. However, you could be held liable for losses incurred by SpringSoft or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

6. Payment

Billing. Swiftaudit is a subscription service. We will automatically charge or bill you from the date you convert to a Paid Account and on each periodic renewal until cancellation. You’re responsible for all applicable taxes, and we’ll charge tax when required to do so.

In addition to automatic renewal on a periodic basic, Swiftaudit will offer one-time purchase offers. We will charge you for your purchases.

No Refunds. You may cancel your Paid Account at any time. Refunds are only issued if required by law.

Changes. We may change the fees in effect but will give you advance notice of these changes via a message to the email address associated with your account.

7. Termination

You’re free to stop using Swiftaudit at any time.
(a) You may export your encounter summary data at any time.
(b) Cancelling a subscription to Swiftaudit will remove your access to coding tools and your data.
(c) Renewing your subscription to Swiftaudit will continue your access to coding tools and your data.

Your use of Professional Profile is a free service. You may delete your Professional Profile information at any time.

We reserve the right to delete data for accounts that are inactive for 1 year or more. Swiftaudit will send notice to the email on the account.

We reserve the right to suspend or terminate your access to Swiftaudit with notice to you if:
(a) you’re in breach of this TOS,
(b) you present offensive, unlawful information through your account or Professional Profile,
(c) your use of Swiftaudit would cause a real risk of harm or loss to us or other users.

8. No Unlawful or Prohibited Use

As a condition of your use of the Swiftaudit, you will not use the Swiftaudit for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Swiftaudit in any manner that could damage, disable, overburden, or impair any SpringSoft server, or the network(s) connected to any SpringSoft server, or interfere with any other party's use and enjoyment of Swiftaudit. You may not attempt to gain unauthorized access to any services, other accounts, computer systems or networks connected to any of the Swiftaudit services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through Swiftaudit.

9. Additional Terms

Your use of Swiftaudit and any content accessed through Swiftaudit is subject to each of the additional terms provided in connection with Swiftaudit, including the Swiftaudit Privacy Policy and the Swiftaudit Legal Notices.

SpringSoft reserves to the right to present aggregate and/or non-identified data usage for the use of Swiftaudit users, such as but not limited to often used ICD-10 codes.

10. Service Availability

We may change, suspend or discontinue any of our Services. We may also modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.

Swiftaudit is not responsible for the service bandwidth supplied to your workplace, whether personal residence or business facility; or controlled by your computer. Swiftaudit will only manage service bandwidth as it applies to all users.

Fee schedules, relative values units, conversion factors and/or related components are not assigned by the AMA, and are not part of CPT, and the AMA is not recommending their use. The responsibility for the content of any "National Correct Coding Policy" included in this product is with the Centers for Medicare and Medicaid Services and no endorsement by the AMA is intended or should be implied. The AMA disclaims responsibility for any consequences or liability attributed to or related to any use, nonuse or interpretation of the information contained in this product.

Per AMA End User Agreement for the right to use CPT®, we are required to provide your name, city, state to the AMA via the AMA licensing portal. We will NOT share your information with the AMA if CPT® is not part of the services you are subscribed to access.

12. Applicable FARS/DFARS Restrictions Apply to Government Use

This product includes CPT® which is commercial technical data and/or computer data bases and/or commercial computer software and/or commercial computer software documentation, as applicable which were developed exclusively at private expense by the American Medical Association, 515 North State Street, Chicago, Illinois, 60654.

U.S. Government rights to use, modify, reproduce, release, perform, display, or disclose these technical data and/or computer data bases and/or computer software and/or computer software documentation are subject to the limited rights restrictions of DFARS 252.227-7015(b)(2) (November 1995) and/or subject to the restrictions of DFARS 227.7202-1(a) (June 1995) and DFARS 227.7202-3(a) (June 1995), as applicable for U.S. Department of Defense procurements and the limited rights restrictions of FAR 52.227-14 (December 2007) and/or subject to the restricted rights provisions of FAR 52.227-14 (December 2007) and FAR 52.227-19 (December 2007), as applicable, and any applicable agency FAR Supplements, for non-Department of Defense Federal procurements.

13. Disclaimer for Links to Other Sites; Offensive Content

Swiftaudit may include content that you find offensive, including health-related content that is sexually explicit.

Swiftaudit may provide links or references to other sites. Swiftaudit has no responsibility for the content of such other sites and shall not be liable for any damages or injury arising from content provided by those other sites. Any links to other sites are provided merely as a convenience to the users of Swiftaudit.

14. Indemnification

You agree to indemnify, protect, and hold harmless SpringSoft and its agents from all fines, claims, demands, losses, costs, expenses, fees including attorney fees, judgments and suits in law (and upon request shall defend same at your expense) that may be asserted against SpringSoft that result from the acts or omissions of you in your use or representation of Swiftaudit, or from your business services based on the your use of Swiftaudit.

15. Software Warranty

SpringSoft hereby disclaims all warranties and conditions with regard to the software, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. For your convenience, SpringSoft may make available as part of the services or in its software products, tools, and utilities for use and/or download. SpringSoft does not make any assurances with regard to the accuracy of the results or output that derives from such use of any such tools and utilities. Please respect the intellectual property rights of others when using the tools and utilities made available by SpringSoft.

16. Limitation of Liability

In no event shall SpringSoft and/or its respective suppliers be liable for any special, indirect or consequential damages, or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from the services.

17. General Terms; Applicable Law

If you have not signed a separate written agreement with SpringSoft related to Swiftaudit, this agreement is the entire agreement between you and SpringSoft related to Swiftaudit, replacing any prior agreements. If there is any conflict between this agreement and a signed written agreement between you and SpringSoft related to Swiftaudit, the signed written agreement will control.

18. Consent to Electronic Communications

By using Swiftaudit, you consent to receiving electronic communications from SpringSoft. These communications may include notices about your account and information concerning or related to Swiftaudit. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
